These general terms and conditions of business are applicable to bookings made directly with Biggestleaf Pty Ltd t/a Biggestleaf Travel (herein known as “Biggestleaf Travel”)
All bookings are deemed to have been concluded, maintained and controlled in the Republic of South Africa and as such, the laws of the Republic of South Africa and the jurisdiction of the South African Court govern any bookings and subsequent contracts entered into between Biggestleaf Travel and our clients.
Biggestleaf Travel quotations are based on anticipated costs and are subject to amendment. Should these anticipated costs increase due to circumstances outside the control of Biggestleaf Travel, increased costs cannot be passed onto Biggestleaf Travel and the company will not take responsibility.
Booking Terms and Conditions
In order to confirm our clients’ reservation, Biggestleaf Travel requires a 50% deposit payment at the time of making your booking. Bookings made within 60 days prior to departure are subject to full prepayment at the time of confirming the reservation. The balance of payment is due 60 days prior to the commencement date of your itinerary. Any of the suppliers specific conditions that vary from the above will apply. Failure to do so will result in your reservation automatically being cancelled.
All bank charges are for the client’s account.
Please note that should you have been quoted in foreign currency and wish to settle payment by means of a credit card, your quotation will be converted to South African Rand prior to the transaction being processed due to foreign exchange regulations by the South African Reserve Bank. The rate of exchange on the day that the transaction is processed will be used to determine the equivalent Rand amount with any resulting foreign exchange differences or bank charges being for the client’s account. The South African Reserve Bank prohibits South African companies from taking foreign credit card payments and keeping the payment in foreign currency. The payment has to be converted to South African Rand before it is credited to the recipient. Clients are welcome to settle payment by means of a bank transfer – in this instance the amount will be converted by your bankers on presentation of our invoice. It is the client’s responsibility to inform and instruct their bankers that the net invoice amount must equal the funds clearing into the Biggestleaf Travel’s bank account and that all bank charges are for the client’s account.
Our Standard Cancellation Policy:
- Cancellation until 60 days prior to travel – 25% of total cost is forfeited
- Cancellation 59 to 30 days prior to travel – 50% of total cost is forfeited
- Cancellation 29 to 14 days prior to travel – 75% of total cost is forfeited
- Cancellation within 13 days prior to travel – 100% of total cost is forfeited
Any of the suppliers specific conditions that vary from the above will apply.
Any cancellations made, in terms of this Cancellation Policy shall be subject to the following deductions:
- Refunds based on a client’s credit card payment: the relevant cancellation fee, less a 3 percent credit card surcharge.
- Refunds based on a client’s direct bank deposits: the relevant cancellation fee, less actual bank charges debited by Biggestleaf Travel’s bankers.
- Refunds based on a client’s forex transfers: the relevant cancellation fee, less actual bank charges debited by Biggestleaf Travel’s bankers.
- Refunds based on a client’s cash payments: the relevant administration charges, less actual bank charges debited by Biggestleaf Travel’s bankers.
Cancellations must be sent in writing to Biggestleaf Travel. Cancellations shall only be effective from the date of receipt of cancellation by Biggestleaf Travel.
Biggestleaf Travel reserves the right to cancel any booking at its sole and absolute discretion, without prior notification in instances where this is unavoidable. However, in that case Biggestleaf Travel agrees to refund all monies already paid by the client. This shall be Biggestleaf Travel´s sole responsibility to the client and no claim for any damages, howsoever arising, shall accrue against Biggestleaf Travel.
It is the client´s sole responsibility to ensure that passports, visas, health certificates, proof of vaccinations and any other documentation required are all in order for the countries to be visited.
Biggestleaf Travel acts only as agent in regard to travel and assumes no liability for injury, damage, loss, accident, delay, war, insurrection, revolt or other civil uprising, other military action, strikes or any Act of God occurring in either the country of origin, destination or through passage, or for any reason whatsoever, or through the acts or default of any company or persons engaged in conveying or accommodating the client. They cannot accept any responsibility for losses or additional expenses due to delay or changes in air schedules or other causes. All such losses or expenses will be the responsibility of the client. Biggestleaf Travel may not be held responsible for any loss or damage to the client’s luggage. The acceptance of final documents, vouchers or tickets shall be deemed to be consent to the above conditions.
